TERMS & CONDITIONS:
All passengers agree to behave in a responsible manner when on or in the vicinity of the ship and have due consideration for other passengers and the crew of the ship. Passengers may be refused entry to the ship if they are under the influence of alcohol or drugs.
Passengers agree to acquaint themselves with the safety rules of the ship at the safety briefing and obey those rules and any safety directives issued by the crew. Note that passengers will not be permitted to climb the rigging if they have recently consumed alcoholic beverages.
(a) Bookings are not considered to be confirmed until full cost of the booking is received. Unconfirmed bookings may be reallocated if payment is not received by the date agreed by the booking officer or within 3 business days of a direct credit date stated on the booking form. All bookings must be made on an official booking form or by supplying all the information sought on such form.
(b) Event may be cancelled due to insufficient bookings, predicted extreme weather conditions or the ship being unexpectedly rendered unfit for sailing. In these cases a refund of any booking monies will be paid in full to the person who made the booking. If your booking is not accepted for medical reasons you will also receive a full refund.
(c) If a booking is cancelled by a passenger or passengers in a booking then the following cancellation fees may apply:
(i) 14 or more days prior to the voyage - 10%
(ii) 7 - 13 days prior to voyage - 50%
(iii) 6 or fewer day priory to voyage or failure to board before departure - 100%
Passengers are urged to complete and pay for their booking as soon as possible after confirming that the number of places they wish to book are available (a) to ensure that their bookings are accepted (see 3 above) and (b) to help ensure that sufficient bookings are received and confirmed by the date on which a decision on whether the event should proceed or not.
As owner of the vessel, The One and All, the Department of Planning, Transport and Infrastructure (DPTI) and its affiliated entities, neither own nor operate, apart from the crew paid by DPTI, any person or entity which is to, or does, provide goods or services for this trip. Because DPTI does not maintain any control over the personnel, equipment, or operations of these suppliers, DPTI assumes no responsibility for and cannot be held liable for any personal injury, death, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned by reason of (1) any wrongful, negligent, wilful, or unauthorized acts or omissions on the part of any of the tour suppliers, or other employees or agents, (2) any defect in or failure of any vehicle, equipment, instrument owned, operated or otherwise by any of these suppliers, or (3) any wrongful, wilful, or negligent act or omissions on any part of any other party not under the supervision or control of the Operator.
